This Privacy Policy is designed to help you understand how Permission Click Inc. (“Permission Click”, “we”, or “us”) collects and uses the personal information you decide to share, and helps you make informed decisions when using permissionclick.com (the “Site”). By using or accessing permissionclick.com or related Permission Click sites, you are accepting the practices described in this Privacy Policy. This Privacy Policy is governed by our Terms and Conditions. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, PLEASE DO NOT USE THE SERVICES.

There are many different ways you can use our services – to share information and forms, to communicate with other people and organizations, or to create new content. When you share information with us, for example by creating an Account, we can make those services even better, helping you connect with people or to make sharing with others quicker and easier. As you use our services, we want you to be clear how we’re using information and the ways in which you can protect your privacy. Our Privacy Policy explains:

  • What information we collect and why we collect it;
  • How we use that information;
  • The choices we offer, including how to access and update information.

We’ve tried to keep it as simple as possible, but if you’re not familiar with terms like cookies, IP addresses and browsers, then read about these key terms first. 1. Information We Collect

Our primary purpose in collecting personal information is to provide you with a safe, secure online application which will assist you in sharing information and forms, to communicate with other people and organizations, or to create new content. In order to do so, Permission Click must collect information to identify users, and to allow our users to identify each other. We only collect information about you that we consider necessary for achieving this purpose.

We collect information in two ways:

  • Information you give us

    For example, many of our services require you to sign up for a Permission Click Account. When you do, we’ll ask for personal information, like your name, email address, telephone number or credit card. We may present your name, email address or image to other users in your organisation, or otherwise associated with your Permission Click account in order to assist in sharing or recommendations.

    You may also choose to provide the following:

    • Social Media Account Information

      When you use a social media account to sign in to the Services, you provide us with the user ID associated with any social media account (e.g., Facebook) that you use. If you sign in with or otherwise connect your social media account to the Services, you authorize us to collect, store, and use in accordance with this Privacy Policy any and all information available to us through the social media interface, including without limitation any information that you have made public in connection with your social media account, information that the social media service shares with us, or information that is disclosed as being shared during the sign-in process. Please see your social media provider’s privacy policy and help center for more information about how they share information when you choose to connect your account.

    • User-Generated Content

      If you choose to comment on our blogs or in our community forums or otherwise volunteer information, you provide us with that information and it may be available to other users and even the public. This means that it can be read, collected, and used by others without our knowledge, including to send unsolicited communications.

    • Profile Information

      Our Services may allow users to search for other users and view those users’ public profile information (also called your “ID”). To change the information appearing in your public profile or to make this information private, please visit your account settings.

    • Information About Others

      You may provide us with information about others when you use the service. You are responsible for receiving prior authorization from the person or entity you are providing information such as personal, health or other sensitive information, like name, email address, telephone number or credit card.

    • Create and Send Forms

      When users create forms through our Services and arrange for them to be sent to recipients, they provide information like name and email address of the recipients. When users want additional assurances about the identity of the individual signing their forms or contracts, they may require us to collect some additional information that we use to authenticate recipients before they are able to sign a form or contract.

    • Refer Friends

      When users use our referral service to tell a friend about our Services, they will provide a friend’s name and email address. We will send a one-time email to the address provided, inviting the friend to try the Services. Permission Click stores this information for the purposes of sending this email and tracking the success of our referral program. The individuals who receive these messages can follow the instructions for unsubscribing in the message or contact us at the email address (privacy@permissionclick.com) to request that we remove this information from our database.

  • Information we get from your use of our services

    We may collect information about the services that you use and how you use them, like when you visit a website that uses our services or you view and interact with our content. This information includes:

    • Device information

      We may collect device-specific information (such as your hardware model, operating system version, unique device identifiers, and mobile network information including phone number). Permission Click may associate your device identifiers or phone number with your Permission Click Account.

    • Log information

      When you use our services or view content provided by Permission Click, we may automatically collect and store certain information in server logs. This may include: Details of how you used our service, such as your links accessed and created or search queries; Telephony log information like your phone number, time and date of calls, duration of calls and types of calls.

    • Internet Protocol address

      Device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL. Cookies that may uniquely identify your browser or your Permission Click Account.

    • Location information

      When you use a location-enabled Permission Click service, we may collect and process information about your actual location, like GPS signals sent by a mobile device. We may also use various technologies to determine location, such as sensor data from your device that may, for example, provide information on nearby Wi-Fi access points and cell towers.

    • Unique application numbers

      Certain services include a unique application number. This number and information about your installation (for example, the operating system type and application version number) may be sent to Permission Click when you install or uninstall that service or when that service periodically contacts our servers, such as for automatic updates.

    • Transactional Data

      Data relating to the forms or contracts you upload or sign on the Services, such as: form metadata, form or contract subject, authentication method used, and form or contract history.

    • Local storage

      We may collect and store information (including personal information) locally on your device using mechanisms such as browser web storage (including HTML 5) and application data caches.

    • Cookies and anonymous identifiers

      We use various technologies to collect and store information when you visit a Permission Click service, and this may include sending one or more cookies or anonymous identifiers to your device. We also use cookies and anonymous identifiers, such as beacons, tags and scripts when you interact with services we offer to our partners, such as advertising services or Permission Click features that may appear on other sites.

    • Information from other sources

      We may obtain information about you from other sources such as marketers, partners, affiliates under common ownership or control with Permission Click, researchers, and others. For example, if you register for Permission Click on another website or use a website that facilitates your activity on Permission Click, that website may provide information about you and your transactions to us.

2. How We Use Information We Collect

We use the information we collect from all of our services to facilitate the transaction and online services that you are engaged in with Permission Click or a third party such as a School, Club or business, which you’re associated with. We also use the information we collect from all our services provide, maintain, protect and improve them, to develop new services, and to protect Permission Click Inc. and our users. We also use this information to offer you tailored content.

We may use the name you provide for your Permission Click Profile across all of the services we offer that require a Permission Click Account. In addition, we may replace past names associated with your Permission Click Account so that you are represented consistently across all our services. If other users already have your email, or other information that identifies you, we may show them your publicly visible Permission Click Profile information, such as your name and photo.

If you use Permission Click to send documents, we will encrypt and store these documents in an account and make the contents available only to those whom you invite to view or sign these files. We restrict our employees’ access to this information so that their access is only as reasonably necessary for us to provide services.

When you contact Permission Click, we may keep a record of your communication to help solve any issues you might be facing. We may use your email address to inform you about our services, such as letting you know about upcoming changes or improvements. If you send us personal correspondence, such as emails or requests for demos, we may collect information, such as name, email address and phone number, into a file specific to you.

If you register for Permission Click on another web site or use a web site providing a service for Permission Click or a web site that helps facilitate your activity on Permission Click, that web site may provide personal information about you and your transactions back to Permission Click.

We use information collected from cookies and other technologies, to improve your user experience and the overall quality of our services.

We may combine information from one service, including personal information, into other Permission Click services – for example to make it easier to share things with people you know.

We may aggregate and/or de-identify the information we collect to limit or prevent identification of any particular user or device. Our use and disclosure of aggregated and/or de-identified information is not subject to any restrictions under this Privacy Policy, and we may disclose it to others without limitation for any purpose.

We will ask for your consent before using information for a purpose other than those that are set out in this Privacy Policy. Permission Click processes personal information on our servers in many countries around the world. We may process your personal information on a server located outside the country where you live.

3. Information You Share

Many of our services let you share information with others. Remember that when you share information publicly, it may be indexable by search engines. Our services provide you with different options on sharing and removing your content.

In order to facilitate interaction among all Permission Click users, our Product may allow you limited access to other users’ contact and authentication status information.

By entering into our User Agreement, you agree that, with respect to other users’ information that you obtain through the Site or through a Permission Click-related communication or Permission Click-facilitated transaction, Permission Click hereby grants to you a license to use such information only for:

  • Permission Click-related communications that are not unsolicited commercial messages;
  • Using services offered through Permission Click (e.g. message or document sending, signing, payment transactions, etc.);
  • Any other purpose that a user expressly agrees to after you tell them the purpose you would like to use it for.

In all cases, you must give users an opportunity to withdraw consent to sign electronically. In addition, under no circumstances, except as defined in this Section, can you disclose personal information about another user to any third party without our consent and the consent of that user. You agree that other users may use your personal information to communicate with you in accordance with this Section.

If you choose to use our referral service to tell another contact about our Site, we will ask you for the contact’s name and email address. We will automatically send your contact an email inviting him or her to visit the Site. Permission Click stores this information only for the purposes of sending email and of tracking the success of our referral program.

Your contact may contact us at the email address below to request that we remove this information from our database.

4. Accessing and Updating Your Personal Information

Whenever you use our services, we aim to provide you with access to your personal information. If that information is wrong, we strive to give you ways to update it quickly or to delete it, unless we have to keep that information for legitimate business or legal purposes. When updating your personal information, we may ask you to verify your identity before we can act on your request.

We will retain in our files some personal information, and past documents, forms and transactions to prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our User Agreement and comply with legal requirements as is permitted by law. Therefore, you should not expect that all of your personal information will be completely removed from our databases in response to your requests. However, such personal information will be deactivated from user viewing and will only be available to select Permission Click personnel.

We may reject requests that are unreasonably repetitive, require disproportionate technical effort (for example, developing a new system or fundamentally changing an existing practice), risk the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes).

Where we can provide information access and correction, we will do so for free, except where it would require a disproportionate effort. We aim to maintain our services in a manner that protects information from accidental or malicious destruction. Because of this, after you delete information from our services, we may not immediately delete residual copies from our active servers and may not remove information from our backup systems.

5. Information We Share

We do not share, sell or rent any of your personal information with companies, organizations and individuals outside of Permission Click unless one of the following circumstances apply:

  • With your consent

    We will share personal information with companies, organizations or individuals outside of Permission Click when we have your consent to do so. We require opt-in consent for the sharing of any sensitive personal information.

  • With account administrators

    If your Permission Click Account is managed for you by an organisation administrator then your organisation’s administrator and resellers who provide user support to your organization will have access to your Permission Click information (including your email and other data). Your account administrator may be able to:

    • View statistics regarding your account;
    • Change your account password;
    • Suspend or terminate your account access;
    • Access or retain information stored as part of your account;
    • Receive your account information in order to satisfy applicable law, Regulation, legal process or enforceable governmental request;
    • Restrict your ability to delete or edit information.

    Please refer to your account administrator’s privacy policy for more information.

  • For internal service providers

    We may use third parties that we refer to as internal service providers to facilitate or outsource one or more aspects of the business, product and service operations that we provide to you (e.g., search technology, authentication systems, bill collection, and fraud detection, and a customer support vendor to provide live chat services), and therefore we may provide some of your personal information directly to these internal service providers. These internal service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit their use of the information we provide them for any other purpose except to facilitate the specific outsourced Permission Click related operation, unless you have explicitly agreed or given your prior permission to them for additional uses.

  • For incident response and maintenance

    We may share personal information with third party service providers of Permission Click in order to perform maintenance or respond to technical incidents affecting our services. Information will only be shared if it is deemed essential to the required operations and in compliance with our Privacy Policy and any other appropriate confidentiality and security measures.

  • For legal reasons

    We will share personal information with companies, organizations or individuals outside of Permission Click if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:

    • Meet any applicable law, regulation, legal process or enforceable governmental request;
    • Enforce applicable Terms of Service, including investigation of potential violations;
    • Detect, prevent, or otherwise address fraud, security or technical issues;
    • Protect against harm to the rights, property or safety of Permission Click, our users or the public as required or permitted by law.
  • With Social Media Services (where directed by you)

    If you connect to a third party service (such as Facebook or Twitter) through an icon or link on the Services or otherwise link your account with a third party service, we may share the contents of your post and associated information (such as your user name, the fact that your connection originated from the Services, and other relevant usage and diagnostic information) with such third party. Once such information is shared, the use of your information will be subject to that service’s privacy policy and this Privacy Policy will not apply.

  • With Affiliates

    We may share your information with other companies under common ownership or control with Permission Click. We may share aggregated, nonpersonally identifiable information publicly and with our partners, such as publishers, advertisers or connected sites. For example, we may share information publicly to show trends about the general use of our services. This could also include government bodies, industry groups, insurers and educational/training facilities.

If Permission Click is involved in a merger, acquisition or asset sale, we will continue to ensure the confidentiality of any personal information and give affected users notice before personal information is transferred or becomes subject to a different privacy policy.

Due to the existing regulatory environment, we cannot ensure that all of your private communications and other personal information will never be disclosed in ways not otherwise described in this Privacy Policy. Therefore, although we use industry standard practices to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private, but you should know that we will take all reasonable steps to provide you a highly secure environment.

6. Other Information Collectors

Except as otherwise expressly included in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. To the extent that you disclose your information to other parties using our system or follow links to other sites, different rules may apply to their use or disclosure of the information you disclose to them.

Since Permission Click does not control the privacy policies of third parties, or other individuals’ actions, you are subject to the privacy policies of that third party or those individuals. We encourage you to be sure the recipients are authenticated to your satisfaction before you send them any documents.

We may use a third party service provider to conduct these surveys to better provide our services to you; that company is prohibited from using our users’ personally identifiable information for any other purpose.

7. Transparency and Choice

People have different privacy concerns. Our goal is to be clear about what information we collect, so that you can make meaningful choices about how it is used and control who you share information with.

You may also set your browser to block all cookies, including cookies associated with our services, or to indicate when a cookie is being set by us. However, it’s important to remember that many of our services may not function properly if your cookies are disabled. For example, you may not be able to login to PermissionClick.com or utilise other services.

8. How We Protect Information

We work hard to protect Permission Click and our users from unauthorized access to or unauthorized alteration, disclosure or destruction of information we hold. In particular:

  • We encrypt many of our services using Secure Sockets Layer (SSL) or Transport Layer Security (TLS);
  • We encrypt many of our systems using industry standard solutions;
  • We review our information collection, storage and processing practices, including physical security measures, to guard against unauthorized access to systems;
  • We restrict access to personal information to Permission Click employees, contractors and agents who need to know that information in order to process it for us, and who are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.
9. Control of Your Password

You are responsible for all actions taken with your User ID and password, including fees charged to your account, and all actions taken with your account. Therefore we do not recommend that you disclose your Permission Click password to any third parties. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password.

10. Children's Privacy

This Site is not intended for children under the age of 13. Permission Click does not target its services or this Site to children under 13. Permission Click does not knowingly collect personally identifiable information from children under the age of 13.

11. Your California Privacy Rights

California law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those parties. As discussed above, we do not currently share personal information with third parties for their own marketing purposes.

12. Application of The Policy

Our Privacy Policy applies to all of the services offered by Permission Click and its affiliates, including services offered on other sites, but excludes services that have separate privacy policies that do not incorporate this Privacy Policy.

Our Privacy Policy does not apply to services offered by other companies or individuals, including products or sites that may be displayed to you in search results, sites that may include Permission Click services, or other sites linked from our services. Our Privacy Policy does not cover the information practices of other companies and organizations who advertise our services.

13. Enforcement of The Policy

We regularly review our compliance with our Privacy Policy. We also adhere to several self-regulatory frameworks. When we receive formal written complaints, we will contact the person who made the complaint to follow up. We work with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that we cannot resolve with our users directly.

14. Changes to The Policy

Our Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent. We will post any privacy policy changes on this page (can be found at www.permissionclick.com) and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of privacy policy changes). All amended terms shall automatically be effective 30 days after they are initially posted on the Site. We will also keep prior versions of this Privacy Policy in an archive for your review.
